摘 要:日本行政型ADR不仅是一种现代非诉讼纠纷解决机制,同时也是行政机关推进社会治理创新的重要手段。为了更为有效地解决纠纷、充分满足现实中日趋膨胀的解纷需求,日本行政机关积极探索行政型ADR与其他纠纷调整机制之间协同运作的可能,并取得十分显著的成效。本研究将围绕日本行政型ADR与苦情处理制度、民间型ADR协同的主题,阐释其背后蕴含的逻辑与意义,以期对未来完善我国以行政调解为中心的多元化非诉讼纠纷解决机制形成有益启示与思考。Japan’s administrative ADR is not only a modern non-litigation dispute resolution mechanism, but also an important means for administrative organs to promote social governance innovation. In order to solve disputes more effectively and fully meet the expanding demand of resolving disputes in reality, Japanese administrative organs actively explore the possibility of coordinated operation between administrative ADR and other dispute adjustment mechanisms, and have achieved remarkable results. This study will focus on the themes of Japanese administrative ADR and bitterness handling system and folk ADR synergy, explain the logic and significance behind it, in order to form beneficial inspiration and thinking for the future improvement of China’s diversified non-litigation dispute resolution mechanism centering on administrative mediation.
