我国跨性别人群权利困境的调查研究

摘　　要：论文采用问卷调查的方法研究我国跨性别人群的现实权利困境。内容主要包括人格权方面、医疗方面、就业方面等。研究发现如下:第一,我国跨性别人群普遍遭遇侮辱、暴力等不平等对待;第二,医疗方面权益损害主要集中在变性手术术前资格审查和术后相关诉讼纠纷等;第三,我国跨性别人群对于加快建设第三性别相关法律法规需求度较大。最后,据此提出了完善我国跨性别人群相关权利制度的针对性建议。The study addressed the realization of the transgender' rights dilemma in China based on questionnaire survey.In this study,transgender rights dilemma included personality right aspect,medical aspect,employment aspects and so on.Three conclusions were drawn from the research.Firstly,transgender generally suffered from unfair treatment,such as insult or violence.Secondly,medical aspect mainly concentrated in transsexual surgery qualification review and relevant of litigation dispute.Thirdly,accelerating the construction of the third gender related laws and regulations was very important to transgender in China.Accordingly,the authors put forward specific suggestions for the improvement of relevant system in transgender rights in China.
