摘 要:从广义法理学来理解,中国有自己传统的法理学。从广义法理学出发,中国传统法观念是天理、国法、人情三位一体的大法观念,包括意识、规则和习惯,表述为合理或者说具有正当性的秩序和规范体系。它的哲学是天、地、人一体的生命哲学,亦即万物有机的世界观。在全球范围内,在人类历史上,中国传统法理学的这些精髓不仅在内涵和特质上独一无二,而且亦同样内含人类法律对真、善、美共同理想的价值追求。中国传统法理学的大法观念有利于克服实证主义法律观的过度狭窄,动态的合理正义观有助于我们确立主体的自觉和文化的自信,而生命哲学亦即有机世界观对机械唯物论和原子世界观的非生命性都是一个超越,从而在法的哲学上形成道德对功利的引导之势,促进人的类本质在法律中的实践和实现,以迎接全球化时代和人工智能发展所带来的挑战。In the broad-sense jurisprudence,Chinese philosophy is a kind of life philosophy with the integration of Heaven,Earth and Man as the organic world view of all the beings. In a global context of human history,such quintessence of traditional Chinese jurisprudence is not only unique in its connotations and peculiarity,but it also internally involves the common ideals of the truth,the good and the virtue. The traditional Chinese large legal conception helps to overcome the excessive narrowness of the positivist legal conception,and the dynamic notion of reasonable justice contributes to the establishment of people's subject consciousness and cultural confidence. At the same time,the life philosophy which refers to the organic world view is definitely a kind of transcendence for the inanimate nature of mechanical materialism and atomic world view. As a result,it will form the moral guidance to utility in legal philosophy and promote the practice and realization of human nature in law to meet the challenges brought by the globalization era and the development of artificial intelligence.
