认罪认罚从宽视域下刑事简化审理程序的本土化省察

摘　　要：我国当下以简易程序和速裁程序为内容的二元"递简"式简化审理体系有其特定的形成、发展脉络及各自类型特征,突出表现在程序类型单一且层次化不足,程序与程序之间衔接不够顺畅,程序设计缺乏一体化机制安排等多个方面。为进一步理顺简化审理程序体系内部的程序梯度关系,推动刑事审判程序的层级化改造,刑事简化审理程序一方面当以认罪认罚从宽的全程性特征为依托,吸收刑拘直诉以及部分地区试点实行的48小时快速结案模式的有益经验,统筹审前程序与庭审程序的平衡塑造,最大限度地实现简化审理程序的"全程"提速;另一方面则当以被告人是否认罪为基准在审判环节设计两种不同的庭审模式,就法庭调查和法庭辩论作出差异化明显的内容安排,并通过重新界定简化审理程序的各自适用范围、增设处罚令程序等方式,实现体系内部程序与程序之间于规范层面与实践层面的顺畅衔接,重构出认罪认罚从宽视域下中国式刑事简化审理程序的完整轮廓及繁简格局。The current System Simplification of Trial Procedure which includes Simply Procedure and Fast Procedure has its own historical evolution process and different traits,such as the single type of the procedure,the lack of level gap and the smooth convergence between different programs and so on. In order to further streamline the procedural gradient relationship and promote the hierarchical construction within the System Simplification of Trial Procedure,on the one hand,the System Simplification of Trial Procedure should rely on the wide range of the Leniency System on Guilty and Punishment Admission,coordinate the balance molding between the pre-trial procedures and the trial procedures for the purpose of maximizing the realization of the complete speed up. On the other hand,the System Simplification of Trial Procedure should make some innovations on the diffluent mechanism construction between cases in which defendant plead guilty and that not guilty,and by redefining the application scopes of the multiple simplified trial procedures and establishing the Punitive Order Procedure to realize the smooth connection among different simplified trial procedures at the normative and practical level,to reconstruct the complete outline of the Chinese-style Criminal Simplification of Trial Procedure System under the sight of the Leniency System on Guilty and Punishment Admission.
