摘　　要："容缺受理"制度目前正处于由个别试点向制度化的过渡阶段。该制度创新有利于促使地方政府提供更人性化的举措,主动服务地方社会经济发展,从而改善区域营商环境,提升地方法治竞争力。从现有情况来看,该制度仍然属于地方政府在现有法律之外的制度创新,尚缺乏明确的法律规范依据,其合法性还存在一定问题。但是该制度设计基于"粗心人"的人性假设,便于民众各项权利顺利实现,符合便民高效的行政法治原则,具有一定的合理性,因而应该尽快将其纳入法制轨道。在制度实施过程中,区分关键材料和非关键材料,加强受理过程中的监管,进一步拓展实施的广度和深度以及引入社会力量参与,是该制度创新进一步发展完善的重要路径。The system of admissibility is in the transitional stage from individual pilot to institutionalization. The institutional innovation is conducive to stimulating local governments to provide more humane initiatives and proactively serve local social and economic development,so as to improve the regional business environment and enhance the competitiveness of local rule of law. Judging from the existing legal norms,scholars’ expositions,the explanations of institutional designers,and the normative documents promulgated by various localities,the system still belongs to the institutional innovation of local governments outside the existing laws,and there is still no clear legal normative basis. There are still some problems with its legitimacy. However,the system design is based on the human nature hypothesis of careless people,which facilitates the smooth realization of the rights of the people and conforms to the principle of administrative rule of law,which is efficient and convenient,and has certain rationality. Therefore,it should be included in the orbit of rule of law as soon as possible. How to distinguish the key materials and non key materials in the implementation process of the system,strengthen supervision in the process of acceptance,further expand the breadth and depth of the implementation,and introduce social forces to participate in the design of the system,improve the authority and rationality is an important path to improve the further development of the system innovation.
