黑社会性质组织犯罪的文化成因及其治理

摘　　要：黑社会性质组织从某种意义上说是一个反文化群体组织,其犯罪行为必然受到其相应的犯罪亚文化的影响。具体表现为在封建帮会文化、歪曲的儒家身份认同理念以及暴力和西方拜金主义文化的影响下,根据一定的帮规所形成的反社会犯罪组织。在社会文化视域下,预防当前黑社会性质组织犯罪应继承和发展我国的优良文化传统,构建社会主义核心价值观为中心的中国文化体系,着力加强主流文化及其政治文化建设,剔除封建糟粕和西方的犯罪亚文化观念,强化文化监管职能,清洁文化传播渠道,以消除黑社会性质组织犯罪产生的社会文化根源。The mafia-like gang is,in a sense,a counter-cultural group organization,and its criminal behavior is bound to be affected by its corresponding criminal subcultures.Specifically,under the influence of feudal gang culture,distorted Confucian identity concept,violence and western money worship culture,anti-social criminal organizations are formed according to certain gang rules.From the social and cultural perspective,in order to prevent crimes committed by mafia-like gangs,we should inherit and develop excellent traditional cultures of our country,construct the Chinese culture system centered by socialist core values,focus on strengthening the construction of the mainstream culture and political culture,eliminate the feudal dross and western concept of criminal subculture,strengthen cultural regulatory functions,clean culture communication channels,for the purpose of eliminating the social and cultural roots of crimes committed by mafia-like gangs.
