摘　　要：东西方分权理论的共同智识,推演出国家权力配置存在双重维度。治理维度侧重权力的专业能力和有效使用,制衡维度强调权力的制约监督与人权关怀。监察权作为一项独立的新型国家权力,既满足治理维度的现实需求,亦契合制衡维度的运作逻辑。其与行政权、司法权、反腐败职权、监督执法权均有共相分殊。《监察法》中的程序对治理维度的权力表达较为充分,但在立体化反腐方面仍有提升空间;然其制衡维度设计偏失,造成了监察权的权力越位,也导致人权保障效果不彰。The common wisdom of the separation of powers between the East and the West shows dual dimensions in the allocation of state power. The governance dimension emphasizes the professional ability and effective use of power, while the checks and balances dimension emphasizes the restriction and supervision of power and human rights concern. As an independent new state power, the supervisory power not only meets the practical needs of the governance dimension, but also conforms to the operational logic of the checks and balances dimension. They are divided into administrative power, judicial power, anti-corruption power, supervision and law enforcement power. The procedure in the Supervision Law expresses the power of governance dimension adequately, but there is still room for improvement in three-dimensional anticorruption. However, the design of checks and balances dimension is deviated, resulting in the overstepping of the power of supervision power and the poor effect of human rights protection.
