摘 要:诞生于美国的国际航线联营已成为全球航空运输业转型的新动向。在美国,以反垄断豁免授权为连接纽带,国际航线联营和天空开放经相互借力已实现全面动态融合。国际航线联营以天空开放为先决条件是美国外交政策和反托拉斯法保驾护航的产物,并不存在必然的逻辑关联,也未演进为普世经验法则。须承认全球范围内绝大多数国际航线联营和天空开放融合的既成事实,但亦不能否定国际航线联营可依传统航空运输协定建构的法律逻辑。中国正在尝试国际航线联营和扩大航权安排,并同东盟和澳大利亚等少数地区和国家签订天空开放协定。持续推进航空自由化是新时代中国国际航空运输业的必由之路,但应立足国情循序渐进地拓展国际航线联营和适用天空开放。The joint venture of international airlines born in the United States has evolved into a new trend of global air transport restructuring.In the United States,with the authorization of antitrust exemption as the connecting link,the international joint venture and the open skies have achieved full and dynamic integration through mutual leveraging.Open skies has become the precondition for international joint venture which is actually the product of escorting by the U.S.foreign policy and its antitrust law,and there is no necessary logical connection nor the universal rule between them.The vast majority of international joint ventures and open skies in the world has already integrated,however,it still can not deny the legal logic that an international joint venture can construct in accordance with the traditional air services agreements.China has already tried to establish an international joint venture and expand its air freedom arrangements and has signed open skies agreements with a few regions and countries such as ASEAN and Australia.Continuing to push forward aviation liberalization is the necessary way for China’s international air transport industry in the new era.However,it is necessary to gradually expand the international joint ventures and apply the open skies based on Chinese national conditions.
