两高司法解释中“无证处置危废”法律适用问题研究

摘　　要：就两高司法解释中“无危废经营许可证”的含义及其相关的法律:规定等问题展开探讨,剖析了“无危废经营许可证处置危险废物”与“非法处置危险废物三吨以上”间的区别与法律适用问题,有助于避免或减少环境污染案件查处时罚不当罪的不良结果出现。The judicial interpretation of the 'Unlicensed Hazardous Waste Business Certificate' as well as the relevant laws from SPC and SPP were discussed.Meanwhile,the difference between the 'Unlicensed Hazardous Waste Disposal'and 'Illegal Disposal of Hazardous Waste more than 3 tons'and their application were deeply analyzed,which was beneficial to avoid or decrease the situations of the undue punishment during the investigations of the environmental pollution cases.
