民族法治视角下少数民族习惯法的现代化转型——以达幹尔族习惯法为例

摘　　要：对于我国的社会稳定和社会发展而言,少数民族习惯法曾发挥了不可代替的作用。通过梳理达斡尔族习惯法的基本内容,分析了达斡尔族习惯法的现代化转型之路。整体来看,达斡尔族习惯法的现代化转型速度是很快的,也是很成功的。除了国家在政策与资源上给予大力扶持之外,更主要的原因是达斡尔族的公有制观念,这在精神层面上与我国的社会主义法治精神内涵是一致的。基于此,结合现代社会发展和时代背景,推动少数民族习惯法的现代化转型,基本思路一是国家层面的引导,二是少数民族习惯法自身的转变。The customary law of ethnic minorities has played an indispensable role in the social stability and social development of our country. This paper reviews the basic content of the customary law, and also analyzes the modern transformation of the customary law of Daur nationality. Overall, the speed of modernization of Daur customary law is very fast and also very successful. In addition to the great support of the state in policies and resources, the main reason is the concept of public ownership of Daur nationality, which is consistent with the connotation of the socialist rule of law in China in spirit. Based on this, in combination with the development of modern society and the historical background, the basic idea of promoting the modernization transformation of the customary law of ethnic minorities is the guidance at the national level and the transformation of the customary law of ethnic minorities themselves.
