国际明星药物专利布局对我国制药企业专利策略实施的启示

摘　　要：通过查阅国内外相关文献,搜索有关专利,了解目前国内制药企业专利策略的实施现状。分析赛诺菲、吉利德、葛兰素史克明星药物专利布局情况,总结其专利布局经验,为国内制药企业提供一定的专利策略启示。国际知名制药企业往往能够在药物专利的不同时期通过采取不同的专利保护策略,保护自身知识产权不被侵犯。虽然上述公司专利保护策略安排缜密,但并非无隙可寻,国内企业仍可通过创新原有专利策略,寻找契机,突破专利壁垒。我国制药企业应密切关注国际专利局势,寻找"专利空隙",在已有化合物专利的基础上进一步研发,实施二次创新;或在已有专利的外围衍生专利上下功夫,走出适合我国国情的专利策略之路。This study aimed to understand the implementation situation of domestic pharmaceutical enterprises'patent strategy by looking up relevant literature at home and abroad,analyzing the starred pharmaceutical patent layout of world-renowned pharmaceutical enterprises such as Sanofi,Gilead and GSK,and summarizing their experience,hoping to provide revelation for Chinese pharmaceutical enterprises to gerenare patent strategy. Internationally famous pharmaceutical enterprises are generally capable of employing different patent protection strategies in different stages of pharmaceutical patent,to protect their intellectual property rights from being violated.Though the aforesaid enterprises hold rigorous patent protection strategies,there is still room for domestic enterprises to seek opportunities and break through the patent barriers by innovating original patent strategies. Chinese pharmaceutical enterprises should keep a keen eye on international patent landscape,seek for "patent gap",conduct further research and development on existing compound patents to realize second innovation;or work on the peripheral derivative patents of existing patents,and explore a patent strategy path catering to China's national situation.
