摘 要:FOB贸易术语下买卖双方风险划分以货物在装运港装上船为界。在春节前等出口高峰期,船公司爆仓导致货物漏装风险剧增,容易引发出口风险。通过一则典型案例,重点分析在货物装上船前出口商、卖方货代和买方货代的责任和风险,并提出相应的解决对策,有利于责任各方做好船货衔接和货物装船的跟踪工作,以避免不必要的损失。Under FOB trade terms,the risk division between the buyer and the seller is based on whether the goods are loaded on board at the loading port. Before the Spring Festival and other peak season,the carriers always have no enough space for every booked shipment,which led to a sharp increase in the risk of misloading,easy to trigger export’s risks. By a typical case,this paper trys to analyse the liability and risk of the exporter and forwarder before goods be loaded on the board,and put forward the corresponding countermeasures,which will help the responsible parties to do a good job in link-up of vessel and goods and tracking of cargo loading,to avoid unnecessary losses.
