摘　　要：明晰的金融产权结构和完善的法人治理结构是建立现代商业银行制度的基本要求;而资本充足率则涉及我国国有商业银行目前面临的诸多问题。我国银行业与证券业从分业经营向混业经营的回归既是国际潮流,也是国有商业银行经营制度变迁的最终选择。我国银行业与证券业混业经营应选择新型的混业经营模式,即这种混业经营模式已不再是单纯地追逐利润,而更多的是竞争所迫或业务开拓所需,具有战略意义。Clear stracture of financial property right and perfect structure of legal person management are the basic requires of establishing the modern commercial bank system.But the capital sufficient rate involve many problems of state commercial bank presently.The return of banking and stock market in our country from separate business management to mixed business management is not only the international trend,but also the final choice of the management system change of state commercial bank.The mixed business management of banking and stock market in our country should choose a new mixing model.The mixed business management model did not seek profit purely,it's the result of the force of competition and the need of business development,and possess strategic significance.
