摘　　要：在近代民主革命运动中，法律斗争处于怎样的地位？护国战争作了明确的回答。护国 战争的发动者们在武装反对袁世凯北洋军阀的同时，十分注重法律方面的斗争。他们运用国 际法、战争法、宪法和刑法的精神和原则，揭露袁世凯破坏民主与法制的犯罪活动，论证武 装反对袁世凯的合法性，寻找护国军及军务院的法律依据。澄清了社会上一些人的模糊认识 ，争取了某些中间势力的同情，获得了广大人民的支持。What status do the legal struggles possess in the democratic r evolutio nary movement in modern China? The 1916 Republic-defending War has given a de finite answer. The organizers of the War paid much attention to the legal strug gles. They used the spirit and principles of international law, law of war, con stitutional law and criminal law to disclose Yuan Shi-kai's crimal activities o f d estroying democracy and legal system in order to demonstrate the legality of th eir fight against Yuan Shi-kai and find legal foundations. In doing so, they clarified some people's hazy views, winning the sympathy of neutral forces and the support of the majority of the people.
