摘　　要：大陆法系与英美法系具有不同的特点 ,两大法系相互借鉴已成为必然趋势 ,在我国同样有必要实行判例制度。实行判例制度对于完善社会主义法制 ,实现司法公正具有重要的现实意义。The civil law system and the common-law system have different characteristics between them. It is the inevitable trend for both of them to use each other for reference. And it is necessary to put the precedent system into practice in our country. It will have important realistic significance for consummating our socialistic legal system and achieving judicial justice.
