摘　　要：新闻自由具有重大的社会意义 ,但新闻自由的滥用具有极大的社会危害性。滥用新闻自由行为的一般表现是新闻侵权 ,对新闻侵权予以明确、合理的法律规定是非常必要的。同时 ,为了保障符合时代需要的新闻自由 ,又必须设置合理的新闻侵权的法定抗辩事由 。The freedom of the press is highly significant to the society. The abuse of the freedom of the press dose a great harm to the society. The general expression of the abuse of the freedom of the press is the tort of the press. It is very necessary to confine the tort of the press by definite and rational legal measures. And in order to guarantee the freedom of the press in accordance with the time, we must set up reasonable legal measures to offset the tort of the press. The press industry will maintain sound development under the mutual condition of the freedom of the press and fighting against the tort of the press.
