摘　　要：认定和处理操纵证券交易价格的案件 ,首先必须科学认识操纵证券交易价格的行为方法和种类 ,在此基础上界定是否属于操纵市场的欺诈行为。同时 ,操纵证券交易价格的行为因其违法性质和程度不同 ,应当承担相应的法律责任 ,包括行政责任、刑事责任和民事责任 ,既不能混同行政责任和刑事责任的适用 ,也不能因为承担行政责任或刑事责任 ,而免除民事责任。追究操纵证券价格等行为的民事责任有其特殊性。Before cognizance and dispose of cases of manipulation security trade price, we must firstly recognize their methods and types, then determine whether they belonging to the act of manipulation security trade price. Meanwhile, according to the difference illegal nature and degree, the act of manipulation security trade price should be responsible to homological legal responsibility including administrative, criminal and civil responsibility. Neither should we confuse administrative responsibility with criminal responsibility, nor should we exempt civil responsibility because of being charged of criminal or administrative responsibility. Though finding out the civil responsibility of act of manipulation security trade price has its particularity.
