关于我国电子商务统一立法的几点思考

摘　　要：针对电子商务发展中的法律问题和现实基础环境 ,设计了我国电子商务统一立法的框架、基本原则和主体条文。统一立法的基本思路 :在中央制定一个指导性的政策框架和宏观法律规范的基础上 ,对全新业务领域进行单独立法 ,对传统领域则通过修改现有法律 ,以适应电子商务实践。Aims at the law problems and the realistic foundation environment under electronic commerce,and designs the law frame,principle and the main bodies of the uniform lawmaking with E commerce in China.The basic thinking of the design is that country formulates a leading policy frame and the macroscopic law norm,proceeds to electronic commerce alone lawmaking in all new realm,then pass to modify the current law to adapt to the electronic commerce fulfillment in traditional realm.
