摘 要:我国历代都极为重视官吏选任和监察。从春秋战国的军功爵制到秦汉时期选官察举征辟制度,从《唐六典》、宋《庆元条法事类》到《大明律》和《大清律》,我国古代对选官条件、标准、权限和程序都作了严格法律规制。最早开始于西汉的官吏选任回避制度,是为防止官员徇私而设。我国古代官吏监督制度分布在古代政令法令中,贯穿于官吏行政的各个环节,《周礼》、《秦律》、《唐律》、《大明律》和《大清律》等都对官吏监察进行了严格法律规制。对我国古代官吏选任和监察法律规制进行流变考证,对我国当前公务员法律规制和西方文官选任和监察制度有一定的启示与借鉴价值。Official selection and supervisory legal regulation in dynasties in China was extremely paid attention to. From the military and jue system of the Spring and Autumn Period and the Warring Period to the Recommend and Counsel system of the Qin and Han dynasties, from "Six Law System" of the Tang dynasty and "Qingyuan Laws" of the Song dynasty to "Law System of the Ming dynasty" and "Law System of the Qing dynasty" , conditions, standards, authority and procedure of Official selection and supervisory in ancient China is strict. The avoidance system of official selection was begun in the West Han dynasty to prevent officials bent the law for personal gain. Official supervision system in ancient China was distributed in ancient decrees and regulated Official selection and supervisory. To research the traceability of legal regulation to official selection and supervisory in ancient china is advantageous to deeper learn official system in ancient china.
