摘　　要：物像权和物名权一样,也是一种符号物权,它是指权利人对其物的图像所享有的占有、使用、收益和处分的权利。物像是物像权的客体,具有符号性、像似性、可识别性、片面性、可复制性、财产性等特质。物像权是图像符号物权,故不同于肖像权、物体权(实体物权)、物名权以及著作权和商标权。通过扩张解释,可入物权法的调整范围。物体权、物名权、物像权分别从不同向度揭示和规定了物权的丰富内涵,共同形成"一体两翼、名(符号)实二元、三权合一"的物权结构体系。同时,物像权因公众的观看与表达自由、财产权的社会性及公众对公物的自由使用等而受一定的限制。Pictorial Real Right which refers to the Real Right of occupying,using,earning and dispose of property image,is also a kind of symbolic real right as well as Appellative Real Right. As the object of Pictorial Real Right,property image has the qualities of symbolic,ironic,identifiability,one-sidedness,reproducibility,property,etc. As the pictorial symbolic property right,Pictorial Real Right differs from Portraiture Right,Substantial Real Right,Appellative Real Right,Copy Right and Trade Mark Right. Pictorial Real Right can be adjusted by the Real Right Law with the extensive interpretation. Substantial Real Right,Appellative Real Right and Pictorial Real Right uncover and define the rich connotation of Real Right by three different ways,and constitute the new Real Right contracture system. Pictorial Real Right can be limited at some extend for public's freedom of observation and expression,the agreement of the property owner,the sociality and reasonable usage,the exploration of public estate and the limitation of the public figures.
