社会抚养费制度与公民生育权的冲突及解决途径

摘　　要：我国宪法明确了计划生育制度,法律又将社会抚养费制度作为实施计划生育制度的重要手段。但社会抚养费制度过度限制了公民所享有的宪法生育权,违背了比例原则。即使当前仍然有必要控制人口,为了满足宪法的要求,国家也只能采取较为柔性的手段,征收人口调节税并采取其他辅助措施可以替代社会抚养费制度。The constitution has confirmed the family planning institution in our country, then, the law took the social support system as an important approach to implement the family planning institution. But the social support system not only excessively limits the reproductive rights that citizens should have enjoyed by constitution, but also violates the proportionality principle. Though it＇s still necessary to control the population now, in order to meet the requirements of the constitution, what our government could do is taking some more flexible measures such as a population adjustment tax and other auxiliary measures to replace the social support system.
