摘　　要：张仲景文化是拥有独立知识产权的知识理论体系和临床实践体系。尽快对张仲景文化传统知识实施有效的保护是摆在我国中医药界重要而紧迫的现实问题。要启动张仲景非物质文化遗产申报工作,完善现有的知识产权保护的法律制度,制定中医药传统知识保护的专门法律,建立张仲景文化传统知识保护名录,明确张仲景文化传统知识产权的受益人,积极参加和制定保护中医药知识产权的国际公约。Zhang Zhongjing culture is a systematic cultural legacy with independent intellectual property rights both in terms of intellectual knowledge and theory and in terms of clinical practice. How to implement quick and effective protection of Zhang Zhongjing culture remains a vital yet urgent task for traditional Chinese medicine circles in China. To that end, efforts must be made to kick off the plan for Zhang Zhongjing culture to be included on the list of world intangible cultural heritages, improve present intellectual property rights protection laws and regulations, promulgate special laws guiding the protection of traditional Chinese medicine, set up a list of traditional knowledge and customs to be covered in the protection of Zhang Zhongjing culture, clarify the beneficiaries of IPR-protected Zhang Zhongjing culture, and actively participate in the formulation of international conventions for the protection of intellectual property rights of traditional Chinese medicine.
