摘　　要：单位犯罪主体资格是单位构成单位犯罪的理论前提。单位犯罪主体资格的一般条件包括:单位行为主体条件和单位刑事责任能力条件。二者是单位成为单位犯罪主体的必备条件,缺一不可,不容割裂。另外,对单位犯罪主体资格进行具体认定必须以上述条件为标准,才能科学界分单位犯罪的主体范围;同时,对于单位犯罪主体资格之否定情形必须创设刑法单位人格否定制度,方能予以相应地规制。Subject qualification of unit crime is the theoretical premise of unit constitutes a crime. The general conditions of subject qualification of unit crime include： unit behavior main body conditions and unit criminal responsibility ability conditions. And both are the essential conditions of unit becoming a unit crime subject, neither is dispensable and not divided. In addition, in order to scientifically divide the scope of the subject of unit crime,concrete determination of unit crime subject qualification must be on the basis of these conditions. At the same time, in order to be accordingly regulated, for the unit crime subject qualification of negative situations criminal law personality denial system must be established.
