摘 要:业主知情权是业主建筑物区分所有权的重要组成部分,并且对业主建筑物区分所有权的实现有重要影响。围绕业主知情权的行使有一系列重要问题,只有这些问题真正解决,业主知情权方能得到切实保障。就业主知情权范围的确定,法律法规外的规范性文件、社区管理文件和物业服务合同应当成为法院判定向业主公开的情况和资料范围的依据。业主知情权虽涉及不同内容,但多个义务主体不利于业主知情权的行使,应将业务主体统一为业主委员会,业主知情权的行使成本才能降到最低。业主知情权存在滥用的可能,需要合理使用"正当目的"要求加以防范。Condominium owner' s fight for information is an essential part of condominium own- ership and the former is significant for the realization of the latter. Concerning the exercise of condominium owner' s fight, there are several problems must be resolved to ensure the protection of such right. For the determination of the right' s scope, courts should refer to rules other than laws and obligations, condominium agreements and rules, property management contracts. It is difficult for condominium owners to exercise such right if different persons bearing the responsibility to provide information. For condominium owners to acquire information at minimum cost, board of condominium association should be the sole person who is responsible for information. To prevent the abuse of such right, "justified purpose" requirement should be used under proper circumstances.
