医务志愿服务中的法律问题浅析

摘　　要：近年来,大陆地区的志愿服务融入了社会生活的各个方面,并得到了蓬勃发展,在医疗卫生领域也发挥了积极的作用。然而医务志愿服务在我国尚属新兴事物,法治化程度不高,制度上和实践中存在着各种问题,因而制约了其发展。笔者从法律的角度分析医务志愿服务实践中存在的问题,着力于厘清相关法律概念,明确各主体之间的法律关系和法律责任,以期提高医务志愿服务的法治化、组织化和规范化水平。The volunteer service has been booming in China's Mainland in recent years, it comes into all aspects of social life and plays a positive role in the area of health. However, the medical volunteer service in our country is still a new thing, the legalization is not so good and it has a lot of problems in system and practice that restricting its development. The authors analyze the problems in medical volunteer service from the legal point to clarify the relevant law concept and to clear the legal relationship and legal responsibility between different subjects, and finally can improve the level of legalization, organization and standardization of the medical volunteer service.
