摘 要:对民办养老机构的补助是资助型给付行政的重要方式,对这一领域的考察可以发现给付行政领域在开展社会化过程中所面临的诸多共性问题。行政补助往往面临失灵的尴尬。大量依靠"规章以下的规范性文件"进行规范的现状,使"法律保留原则"、"司法救济"等资助行政的裁量规制通道都发生阻塞,"程序性规制"是较可行的方式,应明确效率、公平作为程序性规制的两大原则,并设置相应的规则来强化程序设计,解决补助失灵的问题。Administrative subsidy on private nursing home is an important mean of "financially supported welfare administration". Observations on this field can reflect many common issues of privatization in the area of welfare administration. The administrative subsidies are often faced with the embarrassment of failure. Severely relying on "rules under regulations" as basis of administration, the traditional channels for control on discretionary power like "legal reservation" and "judicial,review" are blocked. "Procedural control" is relatively a feasible way. Effectiveness and fairness shall be the key principle for procedural control. Accordingly, certain systems could be designed to meet the failure in administrative subsidy on private nursing home.
