论中世纪大学章程的源起与生发逻辑

摘　　要：现代大学章程的源头可追溯到欧洲中世纪,除了学界公认的中世纪欧洲的教权与皇权所颁发的特许状、诏书及谕旨外,中世纪大学诞生前的学者行会章程,作为地方权力当局的自治市颁布的法令,以及大学诞生后其内部的学院、同乡会等组织的章程,都是大学章程的最初源头。从中世纪大学章程最初出现到逐渐实现制度化,这一过程中始终贯穿着学术性因素的动因,即中世纪大学章程的生发逻辑反映了大学作为一个学术共同体的组织逻辑,即学术本位的逻辑。The modern university statute dates back to ;he Middle Ages in Europe. Its fountainhead in cludes the scholar guild statute, the statute issued by the municipality before the birth of medieval uni versities, and the inner faculty and the native association statu;e, besides the charter and imperial e dict from the magisterium and the imperial authorities. The gradual institutionalization of the universi ty statute since its beginning in the Middle Ages has been driven by the academic factor. In other words, the origin and development logic of the university statute reflect the university logic as an aca demic community, namely the academic principle.
