摘　　要：粮食法保护的法益是粮食安全,这与社会法所保护的"社会利益"高度契合。从立法本位、规制对象、调整方式、法律责任来看,《粮食法(征求意见稿)》都不同程度地体现了社会法的立法定位。粮食法的制定应当坚持社会本位,确立粮食行业组织的法律地位,构建一个政府、市场、社会的三元架构。The legal interest protected by grain law is grain safety; which highly accords with the ＂ social inter- ests＂ protected by social law. Viewed from standpoint of legal standard, regulation object, adjustment mode arid legal responsibility, ＂ Grain Law Draft＂ reflects the legal orientation of social law to some extent. The formulation of food law should adhere to the social standard, establish the legal status of the food industry organizations and construct a triad framework of government, market arid society.
