粮食主产区利益补偿机制研究现状及法理反思

摘　　要：粮食主产区是自然条件优越,适合种植特定粮食作物的区域。在粮食主产区,农业生产的主要任务是粮食生产,这些地区粮食总产量和粮食商品率较高,粮食收入是农民收入的主渠道。学界有关粮食主产区利益补偿机制的研究主要集中在粮食主产区利益补偿的目标和原则、利益补偿的主体和客体、利益补偿方式和补偿标准,以粮食主产区补偿基金为中心的有关问题等领域。对研究的整体评价是,既有成果众多,法学研究缺位;政策建议富裕,法律应对缺欠;应景分析完整,理性反思缺略。Grsin producing areas refer to the areas with superior natural conditions for growing specific crops in the region. In major grain producing areas, the main task of the agricultural production is food production with higher grain output and a higher rate of food commodities, where farmers＇ income mainly comes from grain production. In academia, the research on interest compensation mechanism in major grain producing areas focuses on such issues as the objectives and principles of benefit compensation in major grain producing areas, subjects and objects of interest compensation, compensation modes and standards, issues related to compensation funds in major grain producing areas and so on. An overview evaluation of the research is that many achievements have been made but with the absence of legal resem＇ch ; there have been more than adequate policy recommendations but with few legal countermeasures ; there have been complete occasional analysis but with a shortage of rational reflection.
