摘　　要：文中在分析"海娜号"事件基本案情基础上,着重就该案中船舶扣押的管辖权问题以及旅客的权益保障问题进行了分析,提出要在明确其管辖权的基础之上,正确并合理地行使扣押管辖权,避免对无辜人员造成过度的侵害,同时要注意第三方权益保护。Based on the case study of the incident of the cruiser liner Henna, the paper focuses on the issues of jurisdiction for ship detention and the protection of passengers’rights and interests.It holds that based on determination of the jurisdiction for detention, the jurisdiction should be properly exercised, avoiding unnecessary harm to innocent people and giving due consideration to protecting the rights and interests of the third party.
