摘　　要：确定国际民事诉讼管辖权是法院解决跨国民商事争议的前置条件,对国际民事诉讼程序规范、冲突规范的确定和适用以及法律选择活动具有多重制约和决定作用。本文旨在通过解析国际民事诉讼管辖权产生冲突的成因和形态,从而寻求避免和协调管辖权冲突的法律路径,以期更好地解决相关问题。Determining on Jurisdiction of International Civil Procedure is a precondition of resolving the cross - border civil and commercial disputes for court. It has multiple constraints and decisive roles for determining and applying the norms of the international civil procedure, rules of conflict and the choice of the law applicable. By analyzing the causes and forms of conflicts arising from international civil jurisdiction, it has a significant meaning for seeking legal path to avoid and coordinate the conflicts of jurisdiction.
