国家投资西部工业园型资源循环利用企业若干法律问题探析——以广西为例

摘　　要：发展工业园型资源循环利用企业对我国建立覆盖全社会的资源循环体系有着重要的意义。目前我国西部工业园型资源循环利用企业的兴办处于起步阶段,面临着资金和原料等困难,民间资本基本不具备独立发展工业园型资源循环利用企业的条件。国家基于其环境保护义务、宏观调控的需要,应直接投资参与促进循环经济,国家应当投资西部工业园型资源循环利用企业,为西部工业园型资源循环利用企业的起步保驾护航。To develop resources recycling enterprises in industrial park, can carry huge significance for building an all - cover resource recycling system in China. At present, the establishment of such enterprises in western region is in the primary phase. It faces many difficulties including financing support and raw materials, etc. Besides, Private investment doesn＇ t have the qualification to independently develop such enterprises. This article analysis the needs of coun- try＇ s duty on environmental conversation and macro - control, the regulation models and its superiority of direct participation in promoting circular economy, and then, points out that country is duty -bound to invest in such enterprises, and help such enterprises to get off the ground. At last, the paper also sets forth the legal advices of state investment on resources recycling enterprises.
