“篱笆墙”战略在企业技术竞争中的应用实例

摘　　要：外围专利是企业基础专利的延伸专利,外围专利的有效利用不仅可以阻碍竞争对手的战略发展,同时还可以使自身在该基础专利的使用方面拥有更多的谈判筹码。"篱笆墙"战略是外围专利战略之一,华为对"篱笆墙"的战略使用比较典型。当华为发现有竞争对手试图进军无线网络时,迅速通过申请无线室外小基站的若干项专利给竞争对手基础专利的有效实施或管理制造困难,迫使竞争对手放弃在无线网络领域的发展,从而获得该基础专利的使用权,由此奠定了华为在无线网络方面的明显优势。Peripheral patent is extension of the basic patent of an enterprise;the effective use of peripheral pa-tent can not only hinder the strategy development of the competitor , but also make its elf have more bargaining chips in the use of the basic patent .“The fence” strategy is one of the Huawei peripheral patent strategies , which is very typical .When Huawei found its competitors attempt to enter the wireless network , it quickly made difficul-ties for the rivals through a number of the basic patent applications of wireless small outdoor base stations , forcing its competitors to give up the development in the field of wireless networks , so as to obtain the patent right of use , which gained Huawei obvious advantages in wireless network .
