我国避风港规则的不足与完善——基于美国DMCA的通知—移除机制比较分析

摘　　要：2014年3月至5月,美国专利商标局组织召开了两轮多边利益攸关方对话,推动互联网产业与版权内容产业就如何改进美国数字千年版权法(DMCA)中的通知—移除程序之最佳实践进行交流探讨,并确立了在2014年底前建立更加高效、可靠的通知—移除实践的政策目标。美国在完善通知—移除实践方面的探索,是在互联网技术飞速发展的时代背景下,为更好地遏制盗版内容在网络中传播迈出的重要一步,对我国审视、完善自身的避风港规则有借鉴意义。March 2014 to May, the U.S. Patent and Trademark Office organized two multi-stakeholders dialogue, aiming to promote interactive discussion between Internet industry and copyright content industry on how to improve the practice of the Notice and Take down regime as set forth in the U.S. Digital Millennium Copyright Act （DMCA）, and intends to establish a more efficient and reliable Notice and Take down practice prior to the end of 2014. The exploration on improving the practice of the Notice and Take down system on the side of United States is an important step to further curb the spread of pirated content over Internet under the background of rapid development of Internet technology, and may serve as a good reference for China to examine and improve its own safe harbor rules.
