摘　　要：随着中国城镇化的不断推进,创新农村土地使用权流转模式成为农地改革的现实需求。土地信托作为一种新的农村土地流转形式在中国具有一定的现实基础和法律依据,两大法系主要国家的土地信托模式为我们提供了必要的借鉴,同时与土地租赁相比,土地信托具有无可比拟的优越性。农地信托流转实践中的受益权性质、税收等具体法律问题与农村土地信托模式的成败密切相关。With the continuous progress of urbanization in China, land transfer is necessary in rural re form. The land trust, as a kind of land transfer, has practical basis and legal basis. Compared with land lease, land trust has disadvantages. The concrete legal issues, such as beneficial nature, taxation and so on in trust land transfer, are closely related with the success and failure of land trust mode in rural areas.
