摘　　要：文章从煤炭工程实际出发,运用合同法等相关法律法规,分析了煤炭工程施工合同履行中的突出问题:合同施工范围、设备供货范围、土建与安装工程范围约定不明,设备与材料界限不清,工程量计算规则适用不当,合同约束弱化、人为随意变更等。提出加强煤炭工程施工合同管理的对策:1合同内容约定要全面、完整、明确、具体,规避合同风险;2建立煤炭工程施工合同管理体系,厘清责任,保证合同约束力;3制订煤炭施工合同标准文本,强化合同动态管理。From actual practices of coal projects, a contract law and other related laws and regulations, prominent problems occurred in the implementations of the coal project construction contracts were analyzed, including the problems of a contract construction scope, equipment supply scope, unclear agreement on the civil engineering and installation engineering scope, unclear limits between the equipment and material, improper applied calculation rule of engineering load, weak contract binding, human optional variation and others. Countermeasures to enhance the control of the coal project construction contract were provided. （1）The agreement of the contract contents should be full, complete, clear and certain and a contract risk should be avoided; （2）A management system of the coal project construction contract should be established to have a clear responsibility and to ensure the binding force of the contract ; （3）A standard version of the coal project construction contract should be set up to enhance the dynamic control of the contract.
