公共治理理论的价值思考及制度拷问——兼析药品安全事件频发问题

摘　　要：药品安全事件反馈出公共治理理论在当代中国社会的虚弱性,其价值性受到相当大的质疑。当质疑悬而未决且总是不断重复时,社会就会变得不稳定。当不确定因素增强,而又急待解决该问题,最核心的办法是设立制度防火墙。一旦制度不能起到防火墙作用,将会给社会带来更多麻烦。根据公共治理现状,提出四大对策意见。政府要履行"元治理"角色,构建多元治理,这是治理制度的首要条件;政府应严厉管控制药公司,以市场经济手段和严厉的经济处罚对其进行威慑;强化"制度+技术"建设,在制度的基础上具有治理的可操作性,使社会的权利监督转化为切实的权力监督;对制度进行拷问,梳理其是否适应公共治理的社会需求。Frequent outbreaks of drug security incidents reveals the feebleness of public governance theory in contemporary society, and its value is undergoing interrogation. When questioning hangs unanswered and is repeated, the society will grow unstable. As instability intensifies and demands instant solution, the core measure is to set up institutional firewall. Once the system fails to stop the incidents from happening, the society will suffer. According to the present public governance situation, four measures are put foreward ： first, the government will have to fulfill the role of ＂meta -governance＂, and build multi -governance system, which is the primary condition; second, the government must take tough measures to control the pharmacy companies and deter them with market economy measures and stern economic punishments; the third is to strengthen the ＂bylaws ＋ technology＂ pattern, and base the feasibility of governance on institutions, which will transform the social right supervision into practical supervision of power; the last is to interrogate the system and find out whether the system meets the requirement of public governance.
