摘　　要：互联网催生了跨境电子商务交易,但有效争议解决机制的缺乏严重影响了跨境电子商务的进一步发展,为此需要建立与跨境电子商务交易相匹配的有效争议解决机制——跨境电子商务交易全球性网上争议解决体系。建立跨境电子商务交易网上争议解决体系的尝试为全球性网上争议解决体系的构建提供了参考。网上争议程序的设计、适用法律以及争议解决结果的跨境执行是全球性网上争议解决体系需要解决的主要法律问题。全球性网上争议解决体系整体框架设计和法律问题的解决是全球性网上争议解决体系成败的关键。The Internet has fostered cross-border e-commerce transactions, but the lack of an effective dispute resolution system hinders the further development of cross-border e-commerce, which calls for a competent on-line global dispute resolution system. The proposals for establishment of cross-border e-commerce dispute resolution system provide references for the construction of the global dispute resolution system. The design of on-line dispute resolution procedures, the governing law and the cross-border enforcement of dispute resolutions are principal legal issues facing the global on-line dispute resolution system. The design of global on-line dispute resolution system and the resolution of legal problems are key to the success of the on-line global dispute resolution system.
