城镇规划区范围内集体土地征收利用制度探析

摘　　要：制度的相对滞后既是城市化进程中由土地征收利用所引发的多种问题的根源,又是制约新的改革目标顺利实施的瓶颈。在归纳总结了城镇规划区范围内集体土地征收利用过程中存在的主要问题的基础上,深入分析了引发问题的制度性原因,进而有针对性地提出了明确延续规划区范围内集体经济组织的所有权主体资格、分类设计规划区范围内集体土地的转换途径、以公平合理为导向调整利益分配格局及弹性赋予集体土地权能等完善集体土地征收利用制度的相关建议。The under-developed system is not only the root of various problems caused by the land expropriation and utilization in the process of urbanization, but also a bottleneck preventing the implementation of the new reform goals. This paper summarizes the main problems occurring in the expropriation and utilization of collective land in the urban planning areas and deeply analyzes the institutional factors generating those problems.Based on these results,the paper proposes such measures as improving the expropriation and utilization system of collective land,extending the ownership subj ect of collective economic organizations,designing the ways of collective land conversion,adj usting profit allocation on the principles of equality and reasonableness,and flexibly assigning the functions of collective land in the planning areas.
