政府规制网络舆论的限度分析

摘　　要：面对网络舆论的双刃剑效应,迫切需要保持一种开放性的态度和面对问题的勇气,从反向度的有效思维方式重新认识寻求政府规制网络舆论的范围与边界是探讨政府"如何去规制"网络舆论的基础与前提。从政府规制的客体层面来分析,要意识到存在法治化和公民权利维护表达自由的诉求困境;从政府规制的主体维度来分析,要意识到存在着自身行政控制的失效困境;从政府规制的现实性来分析,要意识到存在着注意力经济影响的局限。因此,政府在网络舆论规制中应该扮演引导性角色,重构政府规制的制度设计和模式创新,建设新型公共治理国家。In the face of double - edged sword effect of the network of public opinion, we urgently need to keep an open attitude and courage to face the problem, an effective way of thinking from the reverse of the new understanding to seek government regulation of the scope and boundaries of the network of public opinion is to investigate the foundation and prerequisite for government ＂how to regulate＂ network public opinion. Government Regulation from the object level to analyze, to be aware of the existence of the rule of law and citizens＇fights to freedom of expression demands maintenance plight; government regulation from the main dimensions of analysis, there is a failure to be aware of the plight of its own administrative control; from government regulation to analyze reality, there are limitations to be aware of the economic impact of attention. Therefore, the government regulation in network media should play a guiding role in the Reconstruction government regulation of the system design and model innovation, construction of new public governance countries.
