摘 要:国际多式联运业的外资准入牵涉到向外资开放东道国的整个国内运输市场,所以相对于GATS体制下的海运业外资准入更为敏感和复杂。我国国际多式联运业外资准入的法律问题主要包括GATS体制下的归类困境、国内法下的外资准入多轨制难题以及外商独资企业的经营资格疑问等问题。中国(上海)自由贸易试验区《总体方案》和《负面清单》并没有直面和解决这些问题,反而在一定程度上使问题变得更为复杂。相关部门在制定自贸区航运业外资准入规定时应当关注我国国际多式联运业准入法律制度可能因此受到的影响,并作出有效回应。此外,中外双边海运协定在自贸区的适用问题也需要谨慎处理。The admission of foreign investment to domestic market of multimodal transport service closely relates to that of maritime transport service, but appears even more complicated due to the fact that the admission of foreign investment to domestic market of multimodal transport service probably means that the entire domestic transport service market will be open to foreign investment. Based on the research on the categorization problems within the current GATS framework, this paper makes a detailed study on the legal issues primarily originating from the "multi-track" problems concerning the admission of foreign investment to China's domestic market of multimodal transport service and the qualification of the wholly-owned foreign capital companies. When it comes to the China (Shanghai) Free Trade Zone, the policy makers are advised to take into consideration the impact of the preferential rules to be made applicable to the shipping industry on the multimodal transport service. Besides, additional consideration should be given to the application of the bilateral shipping agreements in the Zone.
