清末民初司法审判程序性文书的嬗变

摘　　要："批词"与"决定书"分别是中国古代与近代法制的众多表征之一。在清末民初司法审判实践中,传统司法的主要程序性文书"批词"逐渐消亡了,代之而起的是近代司法程序文书"决定书"。这两种文书嬗变的动因来自于法律制度的巨大变迁。＂Pi ci＂ and the Decision Documents was one representation of legal system of ancient China and modern China. ＂Pi ci＂ had been replaced by the Decision Documents in the judicial practice during Late Qing Dynasty and Early Republic of China, which used as one of main procedure documents. The evolution between two legal documents was caused by the tremendous changes of the legal system.
