摘 要:在党的十八大提出深化行政管理体制改革和建设海洋强国的背景下,国务院根据十二届人大一次会议审议的《国务院机构改革和职能转变》的议案,决定重新组建国家海洋局。本文是对此改革的回应,同时对当前海洋行政管理体制能否匹配海洋强国战略以及可能的改革进行了思考:第一,海洋局的设立与其他部委的设立相比存在非惯例性问题;第二,目前的海洋局仍然无力承担越来越复杂的海洋管理和维权重任;第三,大部制改革中海洋扩权与其他部委权力冲突问题难以解决。笔者在此基础上重构了海洋行政管理体制,沿着决策权和执行权相分离的思路,形成"分散管理、统一执法,决策部门、执行部门和信息部门相互合作、相互制约的海洋行政管理体制。"Under the background of "deepening reform of the administrative system and building maritime power" from the 18th National Congress, some scholars bring up the reform thought of the state oceanic administration again. And this article is a response to that. It puts forward a question whether the present marine administrative management system can match our maritime power strategy and possible reform. First, comparing with other ministries and commissions, there is an unconventional problem in the establishment of the state oceanic bureau; Second, the present ocean administration system cannot afford more and more complicated ocean management and maintain the legal rights; Third, it's difficult to solve the power conflict problem between marine power expansion and other ministries and commissions during super-ministries reform; Fourth, the characteristics of the marine administrative management are not prominent. Thus, with the thought of the separation between decision-making and implementation, we reconstructs the marine administrative management system, which is decentralized management, unified law enforcement, mutual cooperation and mutual restriction among decision-making departments, executive departments and information departments.
