摘　　要：以证据审查判断的视角,运用概念辨析层层推进的研究方法,厘清了电子数据和电子文件的关系,电子数据作为一种独立的证据形式通过法律得到了进一步明确,真实性是其产生证据效力的基本要素。对电子文件真实性的含义和内容进行了阐释,并进而提出保障其真实性的建议,以期为现有的电子文件真实性保障工作提供一定的理论指导。It clarified the relationship between the electronic data and electronic records from the perspective of evidence judgment and examination,by using conception propulsion research. Electronic data has been further defined as an independent form of evidence by the means of law,for which authenticity is the fundamental element. With the interpretation of the meaning and content of electronic records authenticity,it came to the suggestion for the methods of authenticity protection. It aimed at helping provide certain theoretical guidance for ensuring the authenticity of existing electronic records.
