试论侦查假说的作业模式和检验原则——以浙江“张氏叔侄冤案”为例  

A Tentative Study on the Working Modes and Examination Principles of Investigative Hypothesis——Taking the Unjust Case of Zhang Hui and Zhang Gaoping for Example

摘　　要："作业假说"是侦查假说的基本特征,"分解式-过程式-回顾式"是其不同形态,各有其特定的工作模式;"统一性"、"否定性"和"客观性"是检验一个合格的侦查假说的基本原则;以其要领衡量,"浙江张氏叔侄冤案"是不应该发生的事件。＂Working hypothesis＂ is the basic feature of investigative hypothesis, with different forms of ＂decomposition - procedural - retrospective＂, which has its own specific operating mode. ＂Unifonuity＂ , ＂negativity＂ and ＂objectivity＂ are basic principles for testing the rationality of an investigative hypothesis. The examination of these essentials reveals that the unjust case of Zhang Hui and Zhang Gaoping should not have happened.
