摘　　要：离婚标准是离婚制度中的关键内容,是法律确定离婚诉讼当事人是否达到离婚条件的客观标准,直接关系到离婚诉讼当事人身份的维系与解除。《婚姻法》中诉讼离婚标准"夫妻感情确已破裂"有其利弊,用"婚姻关系破裂"标准更为合适。Divorce refers to the legal behavior that both sides of the couple agree to dissolve marriage by terminating the marital rights and obligations through litigation. Divorce standard,the key content in the system of Divorce Law,is to determine whether the parties of divorce proceedings meet the objective standard of divorce,and is directly related to the sustainment or termination of the par-ties’identities. Due to the pros and cons of stating“Incompatibility between the couple has been confirmed”,it is better to take“Mar-riage breakdown”as the standard of divorce litigation in“Marriage Law”.
