摘 要:随着中国经济结构的调整和产业转型升级的逐步深入,出现了越来越多的群体劳动争议,学术界针对集体劳动争议的界定存在各种不同的观点。本文基于中国内地近几年群体劳动争议事件的争议焦点和研究文献,对比分析了中国内地、台湾、西方发达国家以及邻国日本与韩国有关集体劳动争议的界定和相关的规制。得出的分析结论是:海外基本上把工会参与的因集体谈判产生的争议视为集体劳动争议,其中集体谈判时的争议界定为利益之争,谈判协议履行期的争议界定为权利之争;而我国则以人数和员工权利争议为集体劳动争议的法律界定,已不能满足进一步规制群体利益争议的现实。论文针对分析结果,给出了中国内地现阶段集体劳动争议的界定、以及相应的规制建议。With the transition of China's economy and society, there has been an increasing number of class labor disputes, and exist different perspectives about the definitions and regulations on class labor disputes in the academic disciplines. Based on the cases of class labor disputes happened in the mainland of China in the last several years, this paper comparatively analyzes the perspectives of the definitions and regulations on class labor disputes among China's Mainland, Taiwan, west countries as well as Japan and South Korea. The conclusions are those: overseas countries and Taiwan basically define disputes arising in the collective bargaining by union and employers as class labor disputes. The disputes appeared during collective bargaining are disputes over interest, and the disputes appeared in the collective contract implemented are disputes over rights. In mainland of China, class labor disputes are now defined according to the numbers of employees involving in terms of disputes over fights. Finally, this paper gives comments on the definition of China class labor disputes and some comments on the regulations for class labor disputes in the context of mainland of China.
