论侦查启动模式——以立案与初查为线索

摘　　要：我国现行的程序型侦查启动模式存在一系列弊端,包括立案程序的虚置化、初查程序性质不明和侦查机关权力过大。除了这种侦查启动模式之外,域外还存在着另一种随机型的侦查启动模式,这种模式有效地控制了侦查机关的权力,更加适应案件办理实践的需要。我国有必要以域外的随机型模式为借鉴,改革本国的侦查启动模式,即弱化立案程序的功能,承认初查的侦查性质,并建立强制性侦查措施的外部审查制度。Our country＇ s existing starting Model of investigation of procedural type, with the principal part of the case registration procession, has several drawbacks, including the non - performance of the case registration procession, the uncertainty of the nature of preliminary investigation and the excessiveness of the power of investigative organizations.Beside this type of starting model of investigation, there is another type in foreign countries called stochastic type. The stochastic type of starting model of investigation effectively controls the power of investigative organizations and meets the needs of case -handling practice.Our country needs to reform the starting model with the reference of stochastic type, including weakening the functions of the case registration precession, admitting the investigative nature of preliminary investigation and establish the system of external review for mandatory investigation measures.
