出入境行政强制概念及分类的问题研究

摘　　要：出入境强制措施本来就存在术语上的表述及分类上的不准确。而2011年6月《行政强制法》的颁布使得"行政强制"这个长期颇具争议性的概念在实定法上得到统一规定,2012年颁布的《出境入境管理法》又涉及到诸多的行政强制。作为一般法的《行政强制法》当然会对出入境管理领域的行政强制行为概念的界定及分类具有指导意义。"出入境行政强制"概念的提出是对"出入境强制措施"这一传统概念进行的匡谬,其重新分类将有助于规范出入境行政强制措施和出入境行政强制执行的程序,提高出入境管理机关的执法水平,引起出入境管理研究界的深入探讨,提供完善相关法律法规的参考意见。根据行政强制措施和行政强制执行的区分标准,出入境行政强制也应分成出入境行政强制措施和出入境行政强制执行,一些原被归类到出入境强制措施的应归类到出入境行政强制执行中。根据其对象或具体实施方式,可再分为对物(财产)、行为和人身自由三种类型。There are some faults with the concept and classification of the exit and entry compulsory means over years.The Administrative Compulsory Law,enacted in June,2011,made a unified term with the concept of administrative compulsion which had been disputed over.There are some contents concerning administrative compulsion in The Exit and Entry Administration Law of the People's Republic of China(2012).As an ordinary law,the Administrative Compulsory Law certainly makes a guiding significance over the concept and classification of the exit and entry administrative compulsion.The concept of the exit and entry administrative compulsion is a rectification to the formal traditional concept of the exit and entry compulsory means.Meanwhile,its new classification will help standardize the implementing procedures for the exit and entry administrative compulsory means and the exit and entry administrative enforcement,raise the enforcement capabilities of the entry and exit administrative organs,cause an in-depth exploration into this field in the academics of the exit and entry administration and give a reference to a consummation for relevant laws and regulations.According to the standards for distinguishing administrative compulsory means from administrative compulsory enforcement,the exit and entry administrative compulsion should be divided into the exit and entry administrative coercive measures and the exit and entry administrative executions which will be further classified into three categories such as object(property),behavior and personal freedom in terms of object or the specific way of implementing.
