愚斋义庄案中的政府与民间慈善组织

摘　　要：1927年11月,盛宣怀子女违背庄规分析家族愚斋义庄财产引发纠纷,江苏省政府企图乘机将善产据为己有,但是在中央政府的干预下失败。善产最终被中央政府收入囊中,义庄随之寿终正寝。南京国民政府改变了自北宋以来政府通过监督保护实现义庄自主经管和发展的一贯政策,以保护之名行掌控之实,对义庄的发展起到了阻碍作用。社会慈善事业的健康发展需要政府的监管,但是政府必须遵循通过监督实现保护的基本原则。Sheng Xuanhuai＇s children dismembered the clan Yuzhai Yizhuang＇ s property by breaking the rules in November 1927. The government of Jiangsu province tried to seize the opportunity to receive the charitable property, but failed under the central government＇ s intervention. In the end, the central government received the charitable property and the Yizhuang also died in its bed. The Nanjing National Government changed the consistent policy of realizing Yizhuang autonomous operation and development by supervision and protection since the Northern Song Dynasty into the controlling in nature while the protecting on the surface. The central government＇ s policy hindered the Yizhuang＇ s development. The healthy development of the social philanthropy needs the government regulation, but the government must follow the basic principle of realizing protection by supervision.
